Can we add below 2 clauses in a offer letter (Like any other Bi-party agreement equally applicable to both parties:

"Your acceptance of this offer letter means we will be stopping this search and await your joining as committed by you. This would mean financial and opportunity loss for us and other prospective candidates if you do not join as promised. You will be liable to pay us a penalty of Rs. 2,00,000/- towards these financial and opportunity losses. If you do not pay us the same within 30 days of the promised joining date then we will be free to take appropriate remedies."
Can we add two clauses in offer letter as below:
"Our issuance of offer and your acceptance means that you will stop your job search and leave the current organization and join our organization on the promised joining date. This would mean financial and opportunity loss for you if we withdraw the offer letter. We will be liable to pay you a penalty of Rs. 2,00,000/- towards these financial and opportunity losses. If we do not pay you the same within 30 days of offer letter withdrawal you will be free to take appropriate remedies."

A.See as you are trying to be fair with the candidate by making him and yourself too liable to pay a penalty in case of non-joining the the candidate. This seems to be fair to me and I would say yes that it should be added to safeguard both parties interest.
