My friend was visiting west bengal(asansol).on his way back to dhanbad(jharkhand) he met with a minor accident with a biker.actually he struck a bike by his car, nothing serious,the biker fall down ,no injuries.the biker got up and tried to get hold of the car keys but my friend was alert and they both started quarreling.lot of people gathered as it was in the middle of a market place.after intervention of people both were seperated and the my friend drove his car back to dhanbad.this incident tiok place in August'2020 and my friend forgot the incident. Recently a relative of his informed him that the biker had filed a FIR against his car registration no. in August'2020 itself.Now what should be done by friend to get it resolved. Kindly suggest.

A.Dear Sir,
If no charge sheet is filed then try to solve the problem by giving some amount to that victim or you may in good books with police and get the FIR ended there itself.

A.Hi,
The Application can be filed by a person under Sec 482 of Crpc to the High court for getting the FIR filed against him quashed.
The Person can approach the High Court for getting the false FIR quashed by filing an application under Sec 482 of Crpc on the following grounds that the acts or omission on the basis of which the FIR has been lodged does not constitute an offence, the offence for which the FIR has been registered against the accused has never happened or the FIR contains merely baseless allegations without any reasonable ground to prove an offence against the accused.
