Hello sir ,

My husband escaped from US immediately after I came back here ..I filed police complaint and divorce here in the US.

He has filed a divorce case in India after I filed in the US.
I personally served him.I didn't serve him through Hague convention

But he hired an attorney in the US and appeared asking the court to dismiss the case .

The judge said they have jurisdiction over the parties and as far as children they said they reserve the ruling .

I guess he is having a hearing soon in India about service to me .

Should I avoid the service or accept and reply them to dismiss the case .

Kindly help .

A.Dear Client,
It is recommended to accept the service and then reply to them in order to dismiss the case as you have already initiated the proceedings in the United States and the judges have said they have jurisdiction over the parties.

A.Dear Client,
Yes, you can definitely file an application before the court to dismiss the petition and if the ex- parte order is passed by the court you can challenge that oder within 30 days before the court.

A.Dear Madam,
Better you get divorce in US as he appeared through his attorney and such divorce is valid even in India. Then produce a copy of such order before Indian Court and get close Indian Divorce case.

I could have explained more if background is known to me.
