Differces in Marriage

Hello Sir,
We are a couple(muslim) married for 6 years now and with two kids. We have been in to several issues right from the beginning of marriage. One major reason for our differences is that, she is a very religious person and i am not. We have our differences in my habits, going out with friends etc..She want's me to live my life per her terms and I cannot do that. I tried to do that for my kids. But, i was not being happy about it. We have come to this end that she told me,she does not want to be in this relationship and I agree with her. We are not happy together. I am more concerned about the custody of my children and if my wife/in-laws lay any false accusations, when I/we proceed with divorce. What approach should i take here legally ?
You must go to the Civil Court/Family Court to get your marriage contract cancelled.

you can proceed with your divorce on the ground of mutual consent as both the parties are willing to separate and for this, it is recommended that you both live separately for at least 1 year to sort the differences and then use it as a solid point in the court. With respect to false accusations, it can be avoided if you proceed through mutual consent ground and for custody, you can take this matter at the same time.
