The father of my son has not met him since birth. My son is to turn 5 years old. Will the father be eligible for custody of the child? The onus to prove the same lies on the mother or father?

A.Though the father of a child is the natural guardian but under several circumstances the custody of the child always stay with the mother only. To get the best possible remedy you need to have a proper consultation with all the relevant documents and brief facts regarding the matrimonial life, behavior and nature of your husband, source of income, family background etc.

A.Dear Sir,
Father has no concern for the child for all these five years as such no Court can give custody of the child to the father.

I could have explained more if background is known to me. If background is made known in full then legal experts will be in position to understand correctly. Moreso, the background must be in brief.

A.Dear Client,
Usually, it is the mother that gets custody of such young children as they need maternal affection to grow up. If the father has never met him, then it is very hard to get custody as welfare of the child is the priority looked in such matters,
