currently we are a hindu family of 5. Mother, father, me, brother and my uncle(mother's brother). The house that we stay in was bought by my grandfather(mother's father). When he passed away he made my uncle the owner of the flat. My uncle is mentally challenged so the flat was made on his name and my mother and our family shifted there as his caretaker. My mother is verbally abusive and she does not get along with anyone of us. So at times she has threatened to me and my brother saying that we will have no rights on this property. This is her second marriage and she has a son from her first marriage. We don't have any contact with him but she is in contact with him. Sir/ma'am please advise regarding mine and my brother's rights on this property.

A.Dear Sir,
In fact legally you have no rights over the said property. It would be a unnecessary litigation better leave the place and grow financially.

I could have explained more if background is known to me. If background is made known in full then legal experts will be in position to understand correctly. Moreso, the background must be in brief.

A.Dear Client,
The grandsons or granddaughters have no right to inherit or claim any share in the property of the grandfather if their own father or mother is alive. The grandchild does not have a birthright on the self-acquired property of the grandparent. However, the property can be acquired after the demise of your mother.

A.After your maternal uncle's death,if he is unmarried,then your mother will inherit that property so she is justified in her claim because as your maternal uncle is mentally challenged so he cannot be entitled to make Will in favour of you or any body else.
