My case is pending in the Gujarat High court since 2018 and full fees was paid to the lawyer but still he is not taking adequate intrest in the case. I want to speedup the case. How can I change the lawyer?

A.Dear Client,
You will have to ask for a Non-Objection Certificate (NOC) from the lawyer who was working on your cases and then use it through the vakalnama of the new lawyer. If the lawyer refuses to give Consent or NOC, then you can engage another lawyer and file a document in writing (by the client) under Rule 4(2) of Order III of the Code of Civil Procedure for leave of court to terminate the appointment of the previous lawyer.

A.Talk to your current lawyer and clear all hai pending fees and ask him to return the documents/briefs and ask him to give NoC on his letter head and/or the Vakalatnama to used for next lawyer and thereafter you can appoint next lawyer or first appoint another lawyer and than talk to your current lawyer.

A.Dear Sir,
You can get issue a notice terminating this services if he did not agree for issuing no objection certificate to change the advocate.

I could have explained more if background is known to me.

A.First of all you have to talk with your lawyer that you are willing to take change from him upon due payment of his pending charges,if any, Then you have to contact a new lawyer who will make new Vakalatnama ready for representing you before the Hon'ble Court and on that new Vakalatnama, your present lawyer has to give his written consent through no objection for change of such advocate with his signature and date.
