Hello,

I helped one of my relative financially during his illness by quickly getting a personal loan for his operation. Though he confirmed verbally in the beginning that he will return total amount within 6 months and till then pay the monthly EMIs of the loan; but, he paid only 3 installments and after that ignored my phone call reminder, text messages, whatsap messages, etc. to pay the monthly loan installments.

One day, I received his reply stating that he couldn't pay me the monthly installment nor the whole amount and furthermore mentioned that I should not keep any expectation for the same.

After reading the text message received by the relative I quickly paid a visit to his house to ask what is the matter and reason for sending such a negative statement for my borrowed money in a text message.

He refused to pay and used abusive language during the conversation (I was able to record little part of the conversation luckily) In the middle of the conversation he assaulted me in anger and (punched me hard on the right side of my skull) and hit me with a stick while pushing me out of the door telling me to get out of his house.

Just to let you know, the amount borrowed from me (2 lakh 50 thousand) was utilized for his operation and I have all the bills pertaining to it; also a bank statement showing the expenses done by me for his illness.

Please guide me as to what legal action I can take against my relative in order to get my money back.

A.Dear Client,
You can go to the police right away and initiate a civil complaint to get your money back. There are many legal safeguards available to you, please consult a lawyer for the same.
