Me and builder(not registered one but the one in our village like mason ) have written an agreement on plain paper to complete my home walls and plaster work for 165000 ,he have taken entire money but work is not completed fully ,we approached police then the SI called him and asked him to come to police station ,at PS the accused agreed to complete the work if we give another 15000 extra after some argument we agreed to give him but he is not coming to work now and fled the village ,does this comes under criminal case like cheating If so what sections can be used to file complaint at police station or should we approach court ? What should I do ?

A.Dear Sir,
It is nothing but cheating case so you may approach Police and get it solved.

A.Sir, as per the mentioned facts in your case you can file a criminal case against him. But at the same time, we have to consider by what way you had paid the amount to that person. If it is by way of the online transaction then it will definitely have proof of transactions and you get the benefit. It's advised to you engage a lawyer for your case. In the initial stage if you have taken the advice then you won't be suffering like this way

A.Dear client,
As a first step you need to issue him a legal notice through your advocate and thereafter it is advised to approach the court for claiming compensation. You may also approach RERA for your remedies but since he is an unregistered builder, RERA may not be as helpful.

A.It is necessary to scrutinize the terms and conditions of such contract agreement to find out whether the provision of deficiency in service can be attracted or not. Please take note that as a Consumer you are entitled to Consumer complaint if there are certain terms in that contract agreement.
