My mother separated from my father 33 years ago when I was 1-2 months old. So there was no divorce or any legal agreement in between them. After that my mother bought property and its on her name. Now my mother has expired and I am her only son. I tried to apply for Legal succession certificate but it was rejected because there was no details of my father as document and I even don't know if he is dead or what we never talked with him but yes he was married again after the separation. We never thought that we will be stuck in here that's why my mother never planned for will and anything So what should I do now? How to get the property papers on my name?

A.Dear client,
You can try filling a title transfer form. Since your father is not a part of your life anymore and you do not know where he is then you should file an affidavit stating all this.

A.Dear client
As you are the legal heir of your mother you have full right on it as it is her self required property. You can give a affidavit regarding the same in the court and get it authorised.

A.Succession Certificate is required to inherit the movable assets of a deceased person. To inherit the immovable property of your mother, you have to make Legal Heir Declaration with the identity proof of yours having your mother's name. Please take note that your father's second marriage during subsistence of his first marriage is null and void and you have property right in your father's property too.
