My father who die in april, had a joint account with my mother with operation clause anyone. In last month my mother withdrawal all money without doing death setelment. Now she is not giving my share as a legal hair from that amount. Me(female) and my mother is the only legal hair of my father.. Is the withdral from bank was iligal?? And How to get my share from this amount??

A.Dear Madam,
Yes, it is illegal that your mother received the amount without disclosing the death of her husband. You may threaten her to receive your share otherwise you go to Police Station.

A.Dear client,
as it was a joint account, the first share will be given to your mother as she is still the owner as per that account records. Although you are a legal heir, in banks this will only come in terms of nomination when both the joint account holders are not there.

A.Dear Client,
Joint account in a bank has one option i.e. either of survivor can operate the account if one holder is demised. Here bank has not done wrong. But , as far as your share in money left in account of your father is concerned, It is itself clear that you mother had been given legal rights after his demise as joint holder in account, and the amount left by your father must have his earned money. So, in absence of any legal document declaring share with you as being daughter child can not be claimed by you legally. But being out of good relation with your mother she would have right to offer you if you have no other means for survive and unmarried.
