I have a joint account(either or survivor) with my mother's aunt. She died recently. There is money is savings account and 2 fixed deposits . I have applied properly for removal of my mother's aunt name from the account. My mothers aunt is unmarried.She had two open accounts in the same branch 1. with her unmarried sister who has also died with RS 5000 balance, 2. with and married childless sister who is bed ridden with 0 balance. The bank has frozen my account and not giving me the rights to my account until the other two accounts are settled. I could not find any law in RBI stating that If a person has died his joint account holder cannot get rights to the account untill all their other accounts are setlled. The bank seems to be harassing me, how can I get a solution in this case

A.Yes you are right that there is no banking laws or rules which prohibits one of the joint account holder to access the account on death of another account holder. If the bank is not listening to you then you have these options;
1. Write a complaint letter to the banking Ombudsman
2. Send them a legal notice through a lawyer
3. File a consumer case against them.

A.Dear client,
It is a policy that when a person is died having joint account, the deceased co owner nominee’s or legal heir’s get his/her share. And if she don’t have first category legal heir than you can look if you are fitting into second category legal heir or third category legal heir and then you can proceed with it.

A.You have to lodge the complaint in writing before the Customer grievance Cell of that Bank asking to resolve the issue within 30 days and in default you have to lodge complaint before the Banking Ombudsman.
