I am business woman we are interior design firm . I deal with furniture and modular kitchen work with mrs.vidya patil dombivli the question of work is 309000 but Vidya patil only paid us 260000 rs by online and 40000 is painding we call her MSG her many times she not giving response not receiving call . When she suffered from COVID she doesn't have mont to give us she said I'll give post dated cheque after work done .but when we completed her she extended it many time and afte a month she said on call I will give Mony by onlinebank transfer . I have all the conversation of call is recorded nd she is also promised me on WhatsApp now she Denied to give Mony what should I do and her hasband speaking with us and said don't call MSG us we will not give you money . So can I file complaint against them in police aur court can FIR take by police yes then what should I write in police station application please suggest something

A.Dear Client,
Since you had a contract with them so you can sent them a legal notice through a lawyer for recovering of the due amount followed by filing a civil case in the local civil court.
As far as criminal complaint is concerned, if you have the contract documents then you can try to file a cheating case with your local police station.

A.You can go for legal action only if there is anything in writing in respect of the amount that was actually supposed to be paid. Only in that case you can file FIR but practically that won't work as this is a contractual breach pertaining matter and such matters are considered civil in nature. You are suggested to issue them legal notice vide lawyer and if they don't reply to the same or don't comply with the same in 15-30 days you can think of filing a civil suit against them for recovery of money. Thank you.
