A.Dear Client,
He will have to come down to India to gift you the property as per the legal process by registering the gift deed to your name. Else if he has a power of attorney then through that power of attorney you can get the gift deed registered in your name.

A.First of all, it is necessary for your NRI brother to appostile either before the Indian Embassy or before the Notary Public of Canada ,a general Power of Attorney in this regard in favour of his India resident relative for execution of that registered Deed of Gift in your favour . Please take note that such Power of Attorney is required to be drafted in such manner that it will contain all the relevant clauses by virtue of which that POA holder will get valid power after due authentication to execute that registered Gift Deed in your favour in India as per the Indian Law.
