Damages of my Car parked in Society Premises
2 years ago
I am staying in a Housing Society in Kandivli Mumbai. I had parked my Car in my Car Parking space allotted by the Society within the Society premises. Somebody put the hard object from top floors and the backside full glass of my car was broken. This had happened 2 times in the span of 6 months. Both the times, I requested the Society Management to find out who has done it using CCTV cameras footage; but they could not find it.
Both the times, I had to repair the backside glass on my own expenses. So I want to know, is Society responsible for protection of my car which is parked in the society premises? Can I ask reimbursement of my expenses from the Society Management?
In order to avoid such incidences, with Society’ permission, I put a net above my Car. Now after 6 months, Society is asking me to remove the net (which I put above my Car to avoid falling any hard objects ) without any valid reason.
Can Society do such reversal in decisions.
This situation is something which is generally not covered under the codified ( written law) but is dealt with in LAW OF TORTS. Send a legal notice to the society taking responsibility of the same and ask them to resolve this or pay the damages. If they do not listen to you then initiate a legal action against them.
