Claim on property based on payments made towards buying it. Claim on property based on payments made towards buying it.

Hi,
I just wanted to understand what all options I have. I had bought a property. Out of family pressure I had added my mother and brother in the property as co owners even though I have been making all the payments right from down payment , legal fees , EMI etc without fail and any contribution from my brother or mother. I do not have very good relationship with my brother these days. Is there anyway I can lay claim on the property or its just a lost cause for me.

A.Dear Client,

You cannot claim the property just because you’re making the payments. You can get your brother’s share of the property with his consent by the way of a gift deed or conveyance deed.

A.Dear Client
It is not possible to claim or reclaim the part of the property in your name just because your paying the EMI. What you have to do is to get those portion transferred in your name through some conveyance deed preferably a gift deed.
