In my divorce case, I (husband) is petitioner and respondent wife has given in writing to the court that my divorce petition should be allowed and I should be given the divorce decree. What next step should i take.

A.Dear Client
If your wife has provided her consent to allow the divorce and there is no objection from her side then you/your lawyer must apprise the court on the same and seek the direction from the court to dissolve the marriage. On an affidavit the same contested can also be converted to MCD.

A.After filing of that joint petition for mutual consent divorce,usually after six months the next date will be given for evidence before the Ld. District Judge or Ld. Additional District Judge, if you and your wife both will give consent for divorce then , then the Divorce will be granted by Judgment and decree. Please take note that when the husband and wife are living separately for prolonged period of time, then the Court can allow even a date for evidence within 15 days from the date of filing joint petition for mutual consent divorce.

A.If there are no claims regarding alimony or maintenance and no children involved and no police complaint or FIR against each other than on the next date you both address the same before the Court and with the permission of the Court talk to the counselor in the Family Court and ask for them to prepare consent terms of your divorce and thereafter with the help of your lawyers convert the petition to Mutual consent divorce petition and submit your affidavits and request the Court to pass the order for divorce. Thank you.
