I have given money to a person without paper work but with cheque.He is now not returning money. Is it anything I can do legally.

A.To give opinion, it is necessary to know when you have paid that cheque to that concerned person and whether there was any verbal understanding with you to pay interest upon that sum. Please take note that until and unless you give him proper demand notice for refund of that sum along with interest or not, then your claim may become time barred by efflux of time and then it will not be possible to file Money Suit.

A.Dear client
Firstly, ask him to return the money paid by you. Record the conversation(Telephonic, Email, post) for proof. Send a demand notice via your advocate. Then, if he does not return the money file a money suit against the proprietary with the District court under order 37 of CPC, 1908. That will be the quickest remedy possible.

A.You may issue him a legal notice through lawyer and if he doesn't make repayment or doesn't reply to your notice within 15 to 30 days time than you may think of filing a money recovery suit against him in the Civil Court of your concerned jurisdictional area. You can also initiate a summary suit against him if the amount is transferred through cheque and bank record of such transaction is available. Thank you.
