I have a friend of mine in the police custody for 25days without case open he’s African an the policy says that he’s illegal in here, and he has to be deported. But he’s passport is valid and he has a blue paper from UN agency
Is it right to keep him in detention for all this days? If he has to be deported who’s going to pay the deportation expenses in this case?

A.Dear Client,
File a Writ Petition in the nature of habeas corpus under Article 226 of the Indian Constitution before a High of appropriate jurisdiction, then the police officers shall be compelled to bring your friend before the court, and then the court shall decide the validity of his stay. Moreover, if the court decides to deport him then the embasy shall bear the cost.
