I have 5 uncles,My father has beend expired and i want to sell the property we all r agree to sell property but my 1 uncle is refusing can i sell the property with my 3uncles after leaving the part of the property of my 1 uncle....

A.Better you approach your uncle and convey him to amicably settle and make settlement deed and he is not listening then go File partition suit.

A.If one of your uncles refuses to sell or give his consent to sell, then file partition suit in respect of all ancestral properties.

A.Hello
As per your talking the property is ancestral. Therefore for selling of property you must NOC from all your uncles. If your one uncle is not ready for selling of property then you may partition your property then after you proceed.

A.No you can't unless you get the order from the court after filing a partition suit.

A deed of settlement is effective when all the claimers had mutually come to an understanding and agreed to divide the property among themselves. Such instrument becomes conclusive and cannot be challenged in any court after its registration.

A.Whether it's ancestral or self acquired property? If you and your uncles want to sale that property then you must have NOC and Consent letter signed by your uncles.ancestral property heirs have their right of pre emptiom before sale of joint property.
