Hi,
I have purchase under construction home me and my wife both were co owner. Which is ready now and my wife is not ready to live with me. We have to do second registry ( purchase) builder is asking to call her for sign
How I can do registry on my name only

if the house yet not registered then you can ask the builder to register the property solely in you name. The wife's name can be removed from the Sale Deed and all the payment can be made by you. Incase you have taken loan from the bank in both the names then you cannot remove her name.

If your wife does not have a loan or mortgage on the property, the simplest way to remove her name from the joint names is for her to execute a release deed or relinquishment deed in your favor with respect to the 50% share that she owns, and you will become the full and absolute owner of the property.
Both you and your wife will need to go to the sub-registrar office where the property is located, where she will have to sign a release or relinquishment deed in your favor (the second party), which will be duly registered.

A.To give opinion in this regard, it is necessary to scrutinize the terms and conditions of the registered Sale Agreement for its scope, meaning ,
effect. It is also necessary to know whether full stamp duty had been paid or 2% Stamp Duty has been paid. Please take note that usually Registry office cannot permit in this regard, until and unless there are specific clauses and averments in Registered Sale Agreement as well as in the Sale Deed so to be registered.
