My mother had joint bank account with my father. He died intestate. My mother gave almost 90% of money to my one sister. 2. Now after 4 years of my father's death, my another sister is claiming her part of the money. For last 4 years, she did not claim as she was not aware of how much amount was in the bank account but now she got to know. 3. Can she claim after 4 years of my father's death 4. If she can, can she file recovery case at her current city of residence city or need to file at the place of father's death. Pls advice.

Yes she can claim the money as she has the right in that amount left by her father. She can't file the case where she resides but at the place where the respondents are residing or where father last resided before death and had the money in the bank account

A.Dear client,
Yes, she can still claim the money since it is legally and rightfully her money. And according to Order IV of the Code of Civil Procedure 1908 (CPC), a suit can be filed at any place where the Defendant resides; or any place where the defendant carries on business or personally works for gain; or the cause of action wholly or partly arises.
