Hello Team, We have a ancestral property from great grandfather. My grandfather share is selled by his brother's family without my family consent. It happened by nearly 5 years. When it came to my notice I went to him and asked about my share but there is no response from them. What is the process to claim the ancestral property?

A.Dear Sir,
He cannot sell more than his share as such you may file suit for cancellation of such sale transaction and claim your share.

A.Dear client,
One cannot sell ancestral property without taking consent from the other members who have a right in the property. You can initiate legal action against your grandfather's brother as he was in the wrong to do so without taking permission from everyone else.

A.Dear Client
For an ancestral property what you have to do is to file a petition for partition in the civil court making all the legal heirs as party to the case. Once filed you or other parties will be required to submit all the relevant docs about the property to the court and basis that the court will go ahead with the justified claims and rights of the parties and pass an order for partition.

The other way to claim your right in the property is file Title suit on the property and others will come to oppose that.
