We have a ancestral property in our native village in tamilnadu, someone has taken illegal trespassed the property and has included his name as joint owner in the A register in 2012. We complaint to local police station and due to inaction we have filed a case in honorable magistrate court in 2017. This case is pending in the court from then.

In the meanwhile we have raised query through RTI in revenue department on the reason for illegal entry of name in our property, as we did not get proper response the issue went to the State information commissioner and he directed the department to taken action on our petition and inform us. Then we have been asked to report in Dy. collectorate for hearing. Post hearing we got letter that they can't take any action as the case pending in court
I hereby wanted to know from experts, if the department which has wrongly issues property ownership to a stranger can't take any action with case pending in court. This response is acceptable and we have to wait for the court to hear the case, what options available need your guidance.

Also the illegal occupant has made a settlement of the property in 2016 (land & house- 200 years old), without any mother document which was also questioned with the registrar and an enquiry pending.

A.Dear Client,
You can file a civil suit before the concerned court for the declaration of the title of the property.

A.Dear Sir,
Immediately approach Higher Revenue Officers in Appeal to delete his name and also approach Civil Court if necessary.

A.Dear Client
If a case is pending in the court on the same issue then it is almost impossible for any party or authority to take any action on the same issue. Since your case is pending hence they will not be able to do anything on that unless there is a court order for the same.
