Hi sir. I have got married into a family where FIL and MIL have been staying seperately without divorce. And I am the second daughter in law. During our marriage my husband was very stubborn about getting his parents together. They stayed together for 1month. But all these years my FIL was the one who took care of the 2 sons, put them I hostel since childhood. After 1 month of our marriage, she was thrown out of the house by the same son who want her back. Reason was my FIL put a condition that he is not going to be in the same house as her. This impacted me to a greater extent but didn't get out of our relationship as I felt I should not judge son based on his father's character. But over years, my FIL started to harass me for dowry in my husband's absence and when I confronted, he denied that he asked me and my husband also blindly believed him. From then, my FIL targeted me and tried to pollute my husband's mind. Which put him into an illegal relationship. When I confronted my husband about it, he was sorry for it and stopped it. But when my son was 1month old, my FIL tried to make some small issues very big and stopped my husband to come and see his son. It has been 2 years now. Since an year, we have been trying through elders on both sides to bring my husband out but he is reluctant to come out, but says that he wants to be in the relationship. My FIL says that his son will not come out and will not give divorce also. They want me to go on my own, but the problem here they do cheap talking about me if I go based on my past experience. It has put me into depression and don't want such relationship. But If my husband is interested, i want that assurance from only him but not my FIL. The worst part is my FIL and his elder son are also divorced. I want to know who gets the custodial rights of my kid if i Fila divorce and, will iget divorce as my husband is not ready to give and want emotionally abuse me. Pls guide

Sorry to know about your situation and pains that you are going through. If your marital relationship has turned so sour and your husband is neither cooperating with you nor he is living with you then it makes sense to dissolve the marriage and move on with your future. You can get the divorce on the grounds of cruelty and desertion by your husband. In all likelihood the custody of the child will remain with you.
