Can a person who is already in prison (under trial) under sections 420 and 376 of IPC apply for transit anticipatory bail for another case (same sections 420 and 376 here also).

A.Dear Client,

No, a person cannot apply for transit anticipatory bail if he is already in prison for some other offence. It can be applicable if he is given bail for the present imprisonment, as logically speaking, since he is in jail he cannot travel to another court or place before the trial of the previous case is finished.

When the accused person is already in custody as undertrial then how will he be able to travel to another place/court unless he gets the bail in the previous case for which he is already in prison. If he is about to get the bail in the current case then he can apply for that.
