Hello,
My father is retired officer from Housing Board. Now the office is offering land(2400 sqft) for the retired employees with subsidized amount. We are two children to him. Now my question is I am ready to pay the amount for the land and planning to construct. Also, my father is willing to gift deed the same to me. Since me and my brother are not in good terms and I am only taking care of my parents. Is it possible to gift deed the land to my name without his consent?

A.Dear Sir,

Yes, Your father can gift the property to you and avoid your brother in the said transaction but after the death of your father your brother may claim a share in the said property saying that it was a bogus gift deed etc...

Since the property will be self-acquired property, your father can gift the same to you without anyone's consent.

A.Such gift deed is required to be registered in your favour in proper manner and it is advisable to have such clauses therein specifying the reason for making such gift in your favour so that in future if your brother will try to challenge it after death of your father, then you will have sufficient proof in your hand regarding your father's intention in that regard.
