I have a property in the name of mine, my husband and my mother.Now I want to remove my husband's name as we are not together now.. please help me with the procedure

A.Dear Client,

As per the facts mentioned, to get your husband’s name removed from the property then you can ask him to execute a release deed.

A.Dear Madam,

Ask your husband to execute the release deed as follows
============================================================
RELEASE OF AN INTEREST IN IMMOVABLE PROPERTY

DEED OF RELEASE is made at Bengaluru, this 6th of February, 2022

BETWEEN:
XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX, hereinafter referred to as the ‘RELEASOR’ of the One Part

AND:
XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXhereinafter referred to as the ‘RELEASEE’ of the Other Part.

WHEREAS –

1. The Releasor and the Releasee, who are Daughter and Father by relation, are joint owners of the immoveable property bearing No. Municipal New No.XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX, situated at XXXXXXXXXXXXXXXXXX and more particularly described in the Schedule hereunder written being the property jointly purchased under registered Sale Deed bearing No. XXXXXXXXXX in CD No.SHRD61 dated XXXXXX registered in the Senior Sub-Registrar, Jayanagar (Shanthinagar), Bengaluru – 560 027.

2. The Releasor does not desire to claim any interest or share in the said property as she is married and well placed in life and she has received sufficient amounts in different forms from her father and she, therefore, desires to release all her share, right, title and interest in the said property so as to enable the Releasee to enjoy the same alone or deal with it as he likes.

NOW THIS DEED WITNESSETH that in the premises and out of natural love and affection for her Father the Releasee, the Releasor hereby releases and quits claim to all her share, right title and interest claim and demand in the said property described in the Schedule hereunder written unto and in favour of the Releasee to the intent and purposes that the Releasee will be sole owner of the said property.

IN WITNESS WHEREOF the Releasor has put her hand the day and year first hereinabove written.

All that part and parcel of the immovable residential property Municipal New No.XXXXXXXXXXX previous Corporation No.6 and Old Corporation Division No.35, XXXXXXXXXXXXXXXXXXXXXXXXXXXXX, situated at 2nd Main Road, Narayanappa Garden, Gurappanapalya, Bengaluru and measuring East to West 30 feet and North to South 45 feet, total in all measuring 1350 Square Feet together with the building constructed thereon and bounded on the;

A.Until and unless your husband executes registered Deed of Relinquishment or registered Deed of Gift/ registered Deed of Transfer in your favour transferring his undivided one-third share in that property, your husband's name cannot be removed from that property.
