Traffic offence - I was caught for tripling on a scooty

Currently I am residing in Dehradun and last evening i was caught for tripling on a scooty. The police then immediately seized the scooty and asked me to appear before the court. Is it correct to just seize the scooty in first offence? The people behind us were 4 of them on a bike, but they were just allowed to go without even paying a challan. Is it because they’re locals here and I’m an outsider?

It is wrong at you part for break traffic rules. You must pay the fine in order to take your scooty back. There is no other legal remedy for you.

A.If you have committed the crime for first time, then you have to pay a fine of Rs. 500\- only but if it is subsequently committed then you have to pay a fine of Rs. 1500/- only as penalty. But no officer has the right to seize your vehicle only for committing the offence of triple riding, though he has seized your two wheeler (illegally) but he must have provided you a challan along with a copy of the seizure list after seizing your two wheeler. If not done then immediately take legal action against such officer with proper consultation of an advocate only.
