I am a fresher graduate in 2020 and have joined a company in jan 2021 as trainee seo executive and kept on training for 6 months (no training provided in real except some suggestions from consultant) and due to regular late payment of salaries i took leave in janary till feb 14 and later i have absconded from the company and put up final mail for leaving the company on february 23 2022 as salary was regularly delayed from 8 months as my salary is already less than 15k with no extra benefits like pf, insurance etc. There were other issues like no proper record of attendance, false payslip pay dates, work from office during covid lockdowns and bad environment for work etc so i was really frustrated further i am an anxiety patient and got treatment for that in past so due to all this it also lead to more anxiety so i have stated this as a reason to them as it was ruining my anxiety. I decided not to serve any notice period and take all the burden on me but i submitted all the necessary things to them and stated late payments and my mental health as prime reasons. They did not ever provide me training, no budget provided for marketing salary was paid less compared to previous employees plus not on time and expected me to deliver very high and whe i couldn't do used to put blames on me and made me work one leaves. I just decided to finally get out of all of this as my anxiety was getting serious and i didn't wanted to take treatment again. Now they are asking me to pay a hefty amount of 80000 including training fees ( no training provided with proof) + 2 month notice + fine for absconding. i have worked for 11 days in january and they have the pay for it on hold too. Also, this is a company where previous settlement records are very bad and i have my ex colleagues as proof for that as even after giving notice and doing all things nicely he had to face extreme delay in fnf with harassment by employer and even other employees had to face a lot of issues after registration or leaving the company. Their employee retention is very bad and also they seem suspicious as they have not mentioned about the project which i actually worked in their policies also they have made their hr policies very biased for employer with no mention for employee benefits like pf, insurance, overtime, bonuses etc but deductions and fines are put up very smartly that even if the slightest of mistakes done they can recover huge amount from employee during fnf.

A.Dear Client
Please specify your question. Whenever you join a company, there must be an employment contract signed between the parties, i.e, the employer and the employee wherein all the clauses are mentioned. If the company works anyway against those clauses, you must take a legal action for the same. However, if was fault at your part as well for not providing any notice period and absconding.
However, if you feel any kind of injustice you may approach the civil court with an advocate for the same.

So what is your question for which you need an answer and have posted the matter here. You need to specify you r question so that we can provide you with an answer. Anyways if you wish you can sent them a legal notice to recover your sues. And if they send you a notice then you will have to reply.

A.You need to be cool and calm before taking any legal step against the said company where you used to work. They must have provided you an offer letter along with the joining letter where all the terms and conditions, leaves, benefits, etc were mentioned clearly. Hence you need to consult with an advocate along with all such documents and clarify your problem. You must take a legal action if you have been mentally tortured and have been exploited. You need proper legal assistance for safeguarding yourself from such companies and their mal practices.
