Application to be filed under order 7 rule 11(d) for dismissal of the plaint
2 years ago
Wanted to know how to prove the date of knowledge of the plaintiff who claims to have knowledge in 2021 only
But the first registration of the agricultural land took place in 2006.
Then 3 multiple registrations.
The plaintiff has drafted the plaint very cleverly to escape the clutches of the limitation period.
A.Dear Sir,
It is very simple since the registered documents are public documents and on its registration it will reflect in the Encumbrance certificate. The aggrieved person ought to have taken EC every year and if he has not taken then it is his problem. But courts are very slow in thing such legal issues to dismiss the suit on the ground of cause of action. You will get justice in High Court if your application is dismissed.
