Sir,

With ref. to the notice Case No. xxxxxxxxx, Dated: - xxxxxxxxx, I, xxxxxxxx, would like to draw your attention towards the fact that, I was an employee in xxxxxxxx Pvt. Ltd. from 2009 to 2020.

My previous employer’s (xxxxxx Pvt. Ltd.). accountant registered my name in professional tax by mistake without my knowledge and awareness. Instead of registering company’s name, the accountant did the registration by the employee’s name.

When I was an employee in xxxxxxxxx Pvt. Ltd., every month I used to pay professional tax from my salary.

Sir, without my knowledge and awareness, my name, email and mobile has been registered in professional tax and I believe the same has been done by mistake by my previous employer’s accountant.

In 2021 also, I got a same notice Case No: xxxxxxxxxxxx, dated xxxxxxx from xxxxxxx sir ([email protected]) and I was asked to appear at the office of the Joint Commissioner of Commercial Taxes, xxxxxx. I appeared in that hearing and explained the same thing to xxxxxxxx sir.
When I contacted my previous employer (xxxxxxxxx Pvt. Ltd.), I came to know that the registration was surrendered later on and I got some documents against that surrender from my previous employer. I submitted those documents to xxxxxxx sir last year.

But, the case was not closed and this year (2022) also I got same notice and I had to appear in the hearing. But still I have been getting similar messages asking me to pay taxes within 10 days. Sir I belong to a very middle-class family and it is very difficult for me to pay any amount.

Sir, I request you, looking into fact that this registration was done by my previous employer’s accountant by mistake and I have no fault in this, I beg you to please cancel this registration.


My question:
1. How to get overcome from this issue?
2. Who will close the registration, the tax officials or I have to do the same?
3. My previous employer is also not cooperating now. What can I do?

A.Dear Sir,

You may approach any professional auditor or advocate and hire their services to save you from the present situation. The concerned department will understand your problem and may rectify the mistakes otherwise approach High Court for necessary directions.

A.Dear Client

As per the facts which have been provided, you can send a legal notice to your previous employer for cancelling the registration in your name for professional tax and if nothing is done then you can file a suit against him.

1. You need to write to the authorities to close the case
2. You will have to do the same and approach them
3. If they are not cooperating then you yourself take all the necessary steps to close it.
