We are in the process of partitioning the agricultural land of the family. Some of the land is in my uncle's name. As per record it is khatyani (khatauni) land, means there is no prior owner of the land in the record. The record is of 1965 and my uncle was 16 yrs old then. My father also has some land in his name but the khatyani shows my grandfather as the first holder. During the transfer of this land to my father, he too was minor. We have demanded that land in the name of grandfather, my father and uncle has to be combined and divided. But my uncle says that only the land in the name of grandfather can be divided. Pl advise whether all the land will be divided or not? Also can a khatyani land be claimed by the owner to be undivisable? Thanks

A.Dear Client,

As per the facts mentioned, you’ll have to firstly prove that the khatyani land is in your uncle’s name and is a joint property. Only after this you can combine all the lands and ask for partition.

If the land khatiyani is in your uncle's name then you have to prove with facts and witnesses that the land was bought in his name but was supposed to be s joint property. If you can do that then you can ask for partition or else no.
