Hi,
Recently our meter in the house has been found to be tempared and it's was done by local electrician hired by my father. Now, electricity department has fined us rs. 2,19,000 which we have paid and now legal proceeding is going on. I need an advise as on if the fines imposed was correct and if the legal proceeding going on is correct and also what is the correct proceedings.

A.Whether it was correct or not depends upon facts, Contact lawyer and defend yourself now.

A.Your act of father is punishable under sec 135 of Electricity Act, 2003, and you have compounded the offence via above fine. Another fact is that the the concern EDD (electricity distribution department) may presumed that you have consumed such quantity of electricity which you have theft from one year and imposed another fine on you. The department can start the civil proceeding against you for recovery such electricity theft. There is no any remedies for you either District court or High Court or consumer court.

A.Usually the department send a notice first and in case of inaction they also file a case. You have to understand here that both civil and criminal liabilities are associated with theft of electricity. The civil liability is about the amount that you have to pay and the criminal liability arises from the action of stealing electricity. As per the Sections 135, 136 and 138 of Electricity Act, 2003 the act of stealing electricity ( electricity theft) is a criminal offence punishable with jail term up to 6 years.
So, although you would have paid the penalty that took care of your civil liability your criminal liability is still open and which needs to be formally closed following the due process of criminal adjudication.
