I paid extra 52k to the decorator, but it's been a year now the person is dodging me, this month he gave the cheque but it was bounced due to insufficient funds. Therefore, I want to send a legal notice.

A.Dear Sir,

It is long process to recover above small amount because lawyer may charge you Rs. 3000 to 5000 and there after you have to file cheque bounce case and it may require 2 to 3 years to dispose.

A.Dear Client,

You can send a demand notice to the decorator asking to return back the extra amount paid. If then they don’t take any action regarding the matter then you can move to the court under section 138 of NI Act.

A.Kindly contact a lawyer immediately with all your relevant documents so that he can send a legal notice to that person. If that person fails to comply to your notice within the stipulated time then you shall take necessary legal action against him before the court with the help of your lawyer only. Then also if that person doesn't pay the penalty then he will be punished with imprisonment only.

A.After dishonour of that Cheque, it is mandatory to demand payment from that Decorator through Demand notice strictly within one month otherwise you cannot take further legal steps under the NI Act.
