My Accidental Death Insurance Claim was approved by the Sessions Court but the insurance company is applied for stay in the High Court and but for stay order the High Court told insurance company to file 100% claim amount in the court within 12 weeks but the insurance company did not pay the amount even after 15 weeks. My question is that insurance company is eligible for apply again for stay and high court will consider that or not. What should I do in this situation? Can I file a petition against them?

A.Dear Sir,

You have to file execution petition and recover the same by attaching its properties. The company cannot get again stay order but your advocate must coordinate with you.

A.Dear Client,

As per the facts which have been provided, whether the Insurance Company will manage to get stay orders or not depends upon the facts of the case. Insurance companies may refuse to pay benefits for an accidental death claim. They can do so by stating that the death was not the product of an accident. They have many tactics at hand to deny benefits. If you believe the company is unfairly trying to contest your life insurance claim, you need to look for someone with the experience in the law and familiarity with insurance company deceit.

A.Dear Client
Was the order passed by the Hon'ble High Court to deposit the amount? If yes then they will have to deposit the amount to get the stay order else there will be no stay order. Yes they may seek permission to deposit after the time provided and its up to the court to either accept or not. Unless the stay order is provided the proceedings on session court will go on.
