My father had 2 acres of land in my native village in survey no 920 which he received from his ancestral, the same has been updated in ROR and received passbook on our name . After marriage dad shifted to city and settled. It's been 30 years we never visited our land and it was unattended.

One of my relative also had a land in the same survey no 920 beside my land (1 Acer) few years back he sold his part of share and later illegally occupied our land and using it for cultivating for 20 years. We are not aware that he was using our land. Recently we kept a govt survey and informed him to vacate our land but he is not ready to leave our land. And threatening us saying the land belongs to them through Adverse Possession.

Only thing forcefully he was in physical land possession expect that he don't have any document on his name.
We complain in police station they are also not taking any action. Please suggest what to do.

Also suggest what are the documents required to file a petition in court.

As said my dad received land after his father demise so we don't have a registration certificate and legal heir certificate because we received it 70 years back. But in Pahani and EC from 1954 to till date record are very clear stating property received from grandfathers to my dad. Please suggest us on this matter.

A.Dear Sir,

If you sleep over your legitimate rights for more than 12 years then you cannot claim return of such land. You may nicely give some amount and get back your land and enjoy.

A.Dear Client,

As per the facts which have been provided, you can hire an Advocate and send a legal notice to your relative for vacating your land and if nothing is done after that as well then you can file a suit against him in the court.

A.Dear Client
You or your dad needs to file a case for Title Suit in the local jurisdiction court where the land is situated with all the relevant documents related to the land. See a property or civil lawyer with all the docs to start the case.
