I have paid 10 lakh as advance money for purchasing a plot in patna bihar 6 month ago on 27/09/2021 executing a sale agreement on 1000 e-stamp paper with a validity of 6 month period. But now i don't want to purchase it because I would not get clear and marketable title over it was the housing co-operative land which is presently in liquidation and the seller had not obtained any noc from it. The only negative point in the agreement is that I would get the refund only when I come to know the property is defective. There is not mentioned in the agreement for forfeiture of the advance money. Kindly guide the procedure to refund the advance amount asap.

A.Dear Sir,
Get issue a legal notice and cancel the agreement and ask for refund of entire amount failing which you may approach Civil Court to get your amount refunded along with interest thereon.

A.Dear Client,

As per the facts which have been provided, you can talk to the seller and come on a mutual agreement to cancel the agreement.

A.Dear Client
You can reach out to the seller and basis the sale agreement you can ask him to cancel and terminate the agreement and seek refund of your advance amount paid to him. As per your question the property is defective as marketable title will not be there hence go ahead with the cancellation.
