A.This is simpler than we all assume but yes the police or the investigating agency has to initiate the process. With the advent of connected phones and devices all the gadgets leave traces in the cyberworld and hence they are very easily trackable.
Within hours of initiating the action the person or the email account holder can be tracked and apprehended.

A.It's technical activity based in computer ip address.If Cyber cell team received any complaint about email account and they found any suspicious about any email holder then the Cyber Cell sends email to the Officials of those companies attached with the official letter from Authorities stating valid reasons for the requested information. Usually the request is processed and the Cyber Cell receives the reply within 2-3 weeks. No Company provides backdoor for Cyber Cell(not at least for Indian Police), because it's violation of user's privacy.
