Custody of my son who is 18 years old
The Physical custody is with the mother. My son is very much attached to me. My son has attained 18 years in Feb2022. The father has been paying maintenance and entire school fees since the Divorce Decree was announced. Can I get permanent custody of my child through the court? And what is the procedure?
A.Dear Client,
In India after attaining a particular age i.e. 9 years as per the Guardians and Wards Act 1890 (GAWA). Once a child achieves the age of 9 years in India, his/her preference for custody is considered.
It is up to your son with which parent he wants to live.
