My husband divorced me in dec 2016 now this year I have taken meher and iddaat amount by his lawyer 61000 and taken original talaq certificate also as my all family planning to leave india soon and migrate to turkey my question is I have filed 498a ipc and 3 4 DP act cases in 2017 now the cases are running my inlaws are attending but my husband did second marriage and has 3 kids will step mother gets custody if he claim for it but his lawyer is saying if I wait for 20 years also the 498a a case will not close as judgment is not possible if main accused is absconding and left indian citizenship forever he wont cum back so better to compromise and do mou with inlaws after settlement will my inlaws claim custody of child as they are sending 2000 per month but husband is absent from cases and childs life also for 6 years plz to migrate to turkey with minor child is possible do I need any consent from father r not single mother can fly to Turkey with 6 year old I have taken divorce from qazzath office and by his lawyer how to take from waqf board I don't have much time to go through courts. How long will it take to close 498a ipc and 3 4 do act cases as 6th year running

A.Dear Sir,
There are two ways to close pending 498A of IPC case. You may approach the High Court and get it closed saying that the matter is settled out of the Court or you may turn hostile before the Trial Court and ask material witnesses to turn hostile saying that matter is settled outside the Court. This process may take 30-90 days time.
