We are 5 children to our parents. Now we are sharing the property between us. One among us has already sold his share when he was in trouble, we all signed in that paper to show our willness.

But, now that one person is not signing in all of our property share agreement. Is his sign really needed? What happens if he doesn't sign the stamp paper agreements ( we dont have facility for registration our area).

Kindly help us.

A.Dear Sir,

If you have proof that he had sold his share then his signature is not necessary and accordingly convince the prospective buyers.

A.Dear Client
Since you all are distributing the property among yourself as per the family settlement then it makes sense that his signature should also be taken wherein you show that his share is zero as he as already sold his share.
When you do this then in future you will not have any problem.

A.Dear Client,
Since your brother sold his share in the joint property, he has nothing to say in the remaining property. the person who bought your brothers share will be the competent party in this case.

A.If that brother sold his undivided one-fifth share in that property to any stranger purchaser, then that Stranger purchaser has now become the owner of that undivided one-fifth share, therefore, that brother doesn't have any right to interfere in your property share agreement but as the property is undivided so at the time of division of property share, that stranger purchaser is required to be a necessary party.
