I have a flat in Andheri-West, Mumbai in a coop housing society, jointly owned by my sister and me. the society wants to go for redevelopment of the building. I am in favour of redevelopment , but my sister is against it.
is it necessary that both should give the consent, my name is first and her second.
if she does not give consent what should i do.
can i take release deed from her after she is paid by me, with the money i will receive from the builder, in such case can i become 100% owner

A.Dear Sir,

It is better to take release deed from your sister and give consent for re development and thus enjoy the property by your self.

A.Dear Client,
redevelopment of the property helps everyone including the owners and hence you should make your sister understand that as it will help both of you. Yes you can get a release deed executed by her or even a gift deed from her so that you become the 100% owner.

A.Dear Client,
you sister also should agree for the redevelopment as she is the co owner of the property. if your sister agrees to issue release deed by the way you have mentioned, then you can proceed.
