I am Jain & was married to lingayat girl 1.5 years back before marriage my wife hasn't said anything about her past but now after marriage she said that she was married to a another guy but because of some problem they got separated within 2 days & mutually taken divorce in home only by signing on stamp paper so it is illegal then how can I prove that to get divorce.

that mutual divorce they got by signing on stamp paper in the home is not valid in the court of law and the marriage exists. so, your marriage with her now will be void. you can file a complaint against her for not disclosing about her 1st marriage with you.

A.That Divorce of that Lingayat lady is not valid and her first marriage subsists as there is no Decree of Divorce from the competent Court of Law . Therefore your marriage is void.
Whoever, having a husband or wife living, marries in any case in which such marriage is void by reason of its taking place during the life of such husband or wife, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
You are entitled to take penal action against her because she concealed from you the fact of her first marriage and she shall be punished with imprisonÂment of either description for a term which may extend to ten years, and shall also be liable to fine.
