Do we have any law on which medical ground any spouse can take divorce ? Suppose wife is keeping unwell and she need care and proper treatment but husband has never given any money for her basic needs and even he used to keep her hungry for a week when they were staying together. As a result gradually she can patient and now her treatment is going on . She is a patient of Glaucoma and Hydrocephalus..

A.She can file a case under 498A(Domestic violence ) in the nearby Police station or can approach court for divorce under mental Harassment and cruelty along with alimony provided there should be proper evidence to prove it.

A.Dear Sir,

Yes, it is cruelty as such on that ground she can lodge complaint Under Section 488A of IPC and also file a case for divorce with huge alimony.
