My wife has joined a medical college for post graduation degree. Since she has joined the college she is a very hard working person.After working continuously for 7 months she applied for 15 days leave which is not sanctioned by her faculty for various reasons.On a particular sunday which was her week off she went to near by town to purchase daily essential goods for herself she there meet with an accident she visited local government hospital there she was advised for 15 days bed rest she immediately intimated her college in written as well in oral form. On joining after 15 days she was humiliated by her HOD verbally who then restricted her to join again even after showing proper medical certificated. i accompanied her when i intervened and ask HOD how can you refused her joining they threatened me along with my wife.they made her write a false apology letter of which she was not guilty. things went fine for 5 months after a period of 5 months she was called upon by HOD in her room. Next day morning she received a SHOWCAUSE notice that she was absent and not performing her duties. She replied to the said showcause stating her that i was only present in your room. She was no been listened to. Again next day she got other Warning letter that you are a habitual offender and you dont perform your duties well. Her HOD write a third letter stating that your medical is false.after that College formed a DISCIPLINARY COMMITTEE against her. She stated all facts to the said committee but now she again got a letter that her INCREMENTS are stopped. Her performance is not satisfactory.
How can they misuse their POST this is a clear example.My wife is in a serious depression these days . She has developed many Physical and Physiological problem. She is not the same person i have known. Suggest me a legal way to handle this else i m am afraid that i will loose my wife.

A.What was the outcome of the DC? If there is any adverse order did she should prefer an appeal before CAT/SAT challenging the order of DC. If no order has been passed by DC, she should file a writ petition before the high court.

A.Dear client you need to issue legal notice through lawyer and file complaint before medical council. If they didn't reply or not provide proper resolution then file petition into high court under experienced lawyer

A.Some states have state administrative Tribunals just like C A T. Most states don't. If your state has S A T, your wife can file an O. A. challenging the order of the disciplinary committee. Otherwise she has to file a Writ Petition before the High Court, ASSUMING THAT IT IS A GOVT. HOSPITAL / COLLEGE.

A.Serve a legal notice.Also send a complaint to medical council of india and Ministry of health of concerned state.

A.If she really met with an accident and she has a doctor's prescription and medical reports then the authority must accept that unless it is well proven that they are false. If you think that they are doing all this to harass her and the condition is severe then only you should take a legal action against them. You can start with sending a legal notice asking them to stop all kinds of harassment.
