Cheques issue without money in bank account

Hello Sir/Madam
I had paid Rs. 80000 (50000 Bank transfer and 30000 cash) to my house builder 2 years back. He has given cheque for it(80000). Even after 2 years he is not returing my money. He doesnot have money in his bank account also now.
What should i do, please suggest
A.Dear Client, was there any agreement? Also, as per the PDC that he has given, did it bounce when you tried to realise it? I f yes then you can file a case against him under section 138 or Negotiable Instruments act, and you as a lender can approach the court and file a civil suit for recovery of money or a criminal suit for fraud/ breach of an agreement.
