1. Divorce petition filed by wife, aged 56 years in a family court in Delhi in March 2018. Husband, aged 60 years, received summons in the first week of April '18 for appearance in May 2018. Husband prepared and filed the reply himself on the second date of hearing in July 2018. The next (3rd) date of hearing is in October 2018.
2. Divorce petition by wife has come without any inkling to husband. There have been no incidents or events preceding the divorce petition that could be the trigger/cause.
3. Wife is seeking divorce on grounds of alleged cruelty continued to be perpetrated by husband and which the wife tolerated over the past nearly 25 years of marriage which inter-alia include dowry, domestic violence, and other sundry allegations narrated in the form of imaginary incidents unspecific in nature i.e. without mentioning date and month and years, or/and name of major players in the events. Incidents/events are separated by years.
4. Wife had never sought any remedy for her alleged woes by way of help/complaint to Police/other authorities or her parents/relatives or parents of husband.
5. Wife is a senior government officer. Couple has two daughters - elder one in gainful employment since June 2016, and younger one in final year of masters’ program. Both daughters are aligned with their mother, and have become hostile to their father after divorce petition by wife. Husband’s parents and other immediate blood relations had never lived with the couple in Delhi.
6. Husband turned an entrepreneur after his last full time job in October, 1996. He had been doing well till 2002 when he incurred major losses and had to wind up the same in 2002-03. Then he turned a freelance professional writer and editor, and a visiting Professor of management in a central university in Delhi. Had been doing well till 2012 when he lost a major client and teaching assignments. For the last 5-6 years, he has had no regular source of income; efforts to get full time jobs bore no fruit.
8. Wife deserted husband on 15th of April, 2018 having left the government flat with her bags and baggage. She forced husband to leave the flat in the third week of July by disconnecting electricity.
QUESTION 1: Does the law allow the respondent in such an abnormally delayed divorce petition to approach the High Court for quashing the same which the family court should have rejected on the ground of abnormal delay – a petition built on allegations of dowry, domestic violence after 25 years of marriage?
QUESTION 2: How can infidelity/adultery on part of wife be proved when there is no direct/concrete evidence available and which is so very difficult to obtain but when circumstantial evidence points to the possibility of infidelity/adultery? Are any court judgements for guidance available!
WHAT I NEED: A competent but trustworthy advocate, a man of integrity who can’t be influenced, and who has a reputation and track record of success in divorce cases. Fees will be paid.

A.Sir it is very sad that at this age u r facing such litigation. All the life we think of our old age. We always do everything to make our wife happy and and in her pleasure we feel our pleasure. But now in old age when a man needs support and need some shoulder to rest his head u r emotionally and physically broken. Just think about the sacrifices which u have done to make her happy in your young age. No thing hurts so much when our dear one commits such a cruel behaviour as your wife is doing with u. A wound of dagger can be healed but when our feelings and emotions r hurt it is much painful to tolerate I need some more details. What is the present position of litigation?

Thanks a lot Sir for your kind and empathetic words. As stated in the query, husband has filed the reply during the second date of hearing in the family court in Delhi in the last week of July 2018. Husband prepared the reply himself without any help from any qualified lawyer. Now the third date is in the second week of October 2018 where the petitioner may submit reply/rejoinder to the objections and submissions made by the husband(respondent). I shall be grateful if you would please throw light on the two questions that I had asked in my query, and which I am reproducing here for your ready reference:
1: Does the law allow the respondent in such an abnormally delayed divorce petition to approach the High Court for quashing the same which the family court should have rejected on the ground of abnormal delay – a petition built on allegations of dowry, domestic violence after 25 years of marriage?

A petition built on allegations of dowry, domestic violence after 25 years of marriage will be quashed by High court.
There r so many case law citations on this point. So u need not worry. No order will be passed against u.
But sir before I give u conclusive advice I want to see the papers of your case. Send be photocopies of the litigation papers.
I only want to see u happy and smiling. I think u will kind enough to deposit some consultation fees and in future if u wish i will come to Delhi and assist u in court only on nominal charges.
I want to make it clear that my only aim is to make u happy and tension free.

A.Limitation Act does not apply to divorce proceedings because it is a continuing cause of action. Though cruelty can be proved in many ways, the grounds of adultery is a double edged sword. Strict proof is needed. Further, adultery should not be condoned for a long time. If condoned, it is not available as grounds. And alleging current adultery on a 56 year old woman should also be done rather cautiously. You can find lawyers stationed in Delhi from Vidhikarya. Moreover, the case will be definitely posted for mediation and counselling. That may be a good way of resolving the issues. If issues cannot be sorted out by mediation, the best way is to defend the Divorce Case itself, like you said, by engaging an advocate stationed in Delhi and of high Integrity. The husband can also file a case for restitution of his rights asking the wife to return home.
