Respected Sir/ Madam

I have rented out a house in a co-op. society. This society has a rule that such owner/ tenant (who rent out ) has to pay Rs 10000 (per agreement of 11 months or lower) to the society towards Development fund /society rent. They collect this amount by cheque only. But they don't show this income in the annual income statement. They only mention this amount in capital account. I argue with the committee everytime that this is illegal as per bylaws and society cannot charge more than 10% of maintenance towards non occupancy charges, but they don't listen and defend saying this Rule is passed in AGM and have to be followed as all other owners are paying. They are threatening to impose penalty and take action against me. They already have collected above 15 lacs towards it from members. Pl advise.

A.Dear client, I am to hear that. However, Per sq, ft method is extensively used for the calculation of the maintenance charges for the societies. On the basis of this method, a fixed rate is levied per sq ft of the area of the flat. If the rate is 3 per sq ft and you have a flat of 1000 sq ft then you will be charged INR 30000 per month.

Nonetheless, if you still wants to complain you can always approach the civil court.
