A.The law primarily dealing directly with sex workers is the Immoral Traffic (Prevention) ACT of 1956. According to this law, prostitutes can practice their trade privately but cannot legally solicit customers in public. In particular, the law forbids a sex worker to carry on her profession within 200 yards of a public place whether from within any building or house or within a distance of two hundred metres of any place of public religious worship, educational institution, hostel, hospital, nursing home or such other public place. Unlike as is the case with other professions, sex workers are not protected under normal labour laws, but they possess the right to rescue and rehabilitation if they desire and possess all the rights of other citizens.

A prostitute who seduces or solicits shall be prosecuted under ITPA. Police can file case under section 8 of ITPA as she is using her residence to entertain customers. She may not be advertising her contact details in newspapers or magazines but police will file false case under section 8 that she is using her residence for prostitution and soliciting customers. She would have to face lengthy court battle that she is not soliciting customers.

A.Prostitution in any form and in any condition is illegal in India. Whether it is conducted from home, hotel or public place the person(s) involved in the profession will be prosecuted under the Indian laws. Even a person who is assisting the main accused in this profession will also be prosecuted.
